Notification on the latest regulation related to imported non-special cosmetics

 On November 9, 2018, National Medical Products Administration (hereafter referred to as NMPA; formerly the CFDA) released the latest regulation Announcement on Implementing Nationwide Filing Management of Imported Cosmetics for Non-special Purpose (No. 88/2018) (hereafter referred to as New Regulation) on its website. New Regulation puts a huge impact on all projects related to the imported cosmetics for non-special purpose.

 

New Regulation clearly states that from November 10, 2018, cosmetics for non-special purpose imported for the first time will be included in the nationwide filing management system (hereafter referred to as New Filing System), and NMPA will no longer accept applications of the Registration Credence of Imported Cosmetics for Non-special Purpose (hereafter referred to as Credence).

 

If Responsible Party in China (hereafter referred to as RP) is registered in Tianjin, Liaoning, Shanghai, Zhejiang, Fujian, He’nan, Hubei, Guangdong, Chongqing, Sichuan, and Shaanxi, the RP shall apply to the local provincial administration for the Electronic Registration Credence; if RP is registered in other regions, it shall apply to NMPA for the Electronic Registration Credence. In addition, if the registered products shall be imported from ports other than the region where RP is registered, the information of the ports and the recipients should be recorded in the system of filing management.

 

For the products applying for NMPA Credence, renewal of Credence or information alteration ofCredence, if the applications have been accepted by the NMPA before the implementation of the New Regulation, NMPA will continue to verify and approve applications according to the previous procedures. Issued valid Credence can be used for importation till its validity. Applications of reissue and correction of Credence can also proceed according to previous regulation.

 

For those applications not yet accepted by NMPA, they should be submitted according to New Regulation (including the applications of Renewal and Alteration) and by reference to Announcement on Filing Management Procedure of Imported Cosmetics for Non-special Purpose in the Pudong New Area of Shanghai(provisional)(No. 88/2018)

 

In recent years, cosmetics registration regulations have been changed very frequently. It is expected that an important regulation will be publicized at the end of this year or early next year, and will have a major impact on cosmetics registration/filling. We will keep a close eye on it.
